These Terms of Service ("Terms") govern your access to and use of the NimbCloud website at nimbcloud.com (the "Site") and any related services (together, the "Services") operated by NimbCloud ("NimbCloud," "we," "us," or "our"). By using the Site, you agree to these Terms. If you do not agree, do not use the Site.

1. Age requirement (21+)

The Site and NimbCloud's products are intended solely for adults 21 years of age or older. By using the Site or requesting information, you represent and warrant that you are at least 21. We do not knowingly provide products, services, or marketing to anyone under 21. NimbCloud vending products are dispensed only through age-verified machines placed in adult-only (21+) locations.

2. About the Services

NimbCloud provides controlled-access vending solutions to business and facility partners in New Jersey. The Site is an informational and lead-generation tool: it describes our offering and lets prospective partners request a consult or join a waitlist. Nothing on the Site is an offer to sell products to consumers.

3. Age-restricted products & compliance

NimbCloud's products include age-restricted tobacco and vapor products. We offer only tobacco-flavored and 0%-nicotine products, consistent with New Jersey's restrictions on flavored vapor products, and we do not sell to anyone under 21. Partners are responsible for maintaining any facility conditions required for lawful placement, and NimbCloud confirms legal eligibility on a per-location basis. Product availability is subject to applicable federal and New Jersey law and may change.

4. Acceptable use

You agree not to use the Site to: violate any law or regulation; misrepresent your age or identity; interfere with or disrupt the Site; or attempt to gain unauthorized access to any system. We may suspend or terminate access for any misuse.

5. Intellectual property

The Site and its content — including text, graphics, logos, and design — are owned by NimbCloud or its licensors and are protected by applicable laws. You may not copy, reproduce, or create derivative works without our prior written permission.

6. No warranties

The Site is provided "as is" and "as available," without warranties of any kind, express or implied, including fitness for a particular purpose, merchantability, or non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or secure.

7. Limitation of liability

To the fullest extent permitted by law, NimbCloud will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising out of or related to your use of the Site.

8. Governing law

These Terms are governed by the laws of the State of New Jersey, without regard to its conflict-of-laws rules. Any dispute will be resolved in the state or federal courts located in New Jersey.

9. Changes to these Terms

We may update these Terms from time to time. Changes are effective when posted to this page, with an updated "Last updated" date. Your continued use of the Site after changes take effect constitutes acceptance.
